Jameis Winston investigation: Affidavit reveals details about accuser’s allegations

A search warrant affadavit issued for the cell phone records of the woman accusing Florida State quarterback Jameis Winston of sexual assault reveals details about her allegations that she was raped in an apartment after a night of drinking with friends.

Fox Sports.com’s Kevin Vaughan reports that the affidavit, which Fox Sports 1 obtained Thursday, says the victim contacted police within an hour of the alleged rape. At the time, the woman said she did not know her alleged attacker. She later identified Winston.

Winston has denied the allegations since they emerged publicly on Nov. 13. His attorney later said the sex was consensual.

The search warrant affidavit, obtained Thursday morning by FOX Sports 1, details her allegation that she was sexually assaulted by someone she did not know – and that she was so impaired that she was unable to tell a detective where the incident occurred. She told the detective that she was with friends who left and she had only hazy recollections of details after that…

“Her memory is very broken from that point forward,” a detective wrote in the document. “She remembers being in what she thinks is a cab” with a “non-descript” African-American man “in the back seat with her.”

“She then remembers entering an apartment on the ground floor (no other description available),” the detective wrote. “She remembers the male taking off her clothes then engaging in penile/vaginal sex with her as she told him to stop and tried to fight him off.”

…“At some point another black male with dreads came into the room and told him to stop,” the detective wrote. “The suspect led the victim into the bathroom and completed the act.

“Her next memory is the suspect dressing her then putting her on a black scooter. She told him where she lived and he dropped her off at the intersection of Call and stadium. The victim has no idea where the incident occurred.”

One thing's for sure: the county DA, the DA's office, and the Tallahassee PD botched this thing six ways from Sunday. Not sure how you could screw up a case worse than they did.

.04 is below the legal driving limit so it's pretty tough to claim impairment in consent to have sex when you, legally, can drive. We'll never know what actually happened. Best of luck to them both in moving on.

She's full of it. The state was under pressure to charge this kid and they still couldn't fabricate enough b.s. to do so. Winston should run like a Hell when the next drama queen shows up. A person can't rape a willing participant.

BOTTOM LINE..JAMEIS WINSTON- IS NOT GONNA BE CHARGED!!  yes, he did have sex with her....&& also the girl's toxic report was she was not drugged and her blood alc level was 0.04...

She was too drunk to fend for herself and she was too drunk to dress herself. The rapist dressed her. It sounds like she was passed out or close to it. But, Jameis also led her to the bathroom to complete the rape, so she was able to walk and she was able to balance herself on a scooter and give directions home. It seems like she wasn't really doing her best to resist.

This story sounds very fishy to me.

uh...there was drinking involved...i still believe that she agreed to the sex and then later felt bad..like i said before it was a 1 time thing and he didnt want to be with the girl, or the girl got mad bc she couldn't trap him..NOW! not saying all athletes are innocent but i just find it suspicious how all the sudden she DROPPED the charges due to being threaten (( if this really did happen there's now way anyone would have dropped the charges..)) If this really happened the way this "lady" said it happened she should have have kept going with the charges..and now all the sudden his career is taking off she wants to bring this all back up...just saying sounds like a HUGE SET UP to discredit this man!!! AGAIN BY NO MEANS AM I SAYING SOME ATHLETES WHO DO THIS ARE INNOCENT..IM JUST SAYING LETS LOOK AT THE TIMING...JUST SOUNDS LIKE REVENGE...

@CindyLou Did you read past the part where it said she was drinking? She went to the cops within an hour of the alleged incident. That doesn't sound like a woman who was trying to "trap" someone. And she never dropped the charges and brought them back again. The police have left the case open.

@AdamCaldwell "If the above statements are true".  That's the problem.  Nobody besides Jameis, the girl, and the witnesses knows if it is true or not.   Winston's side of the story - which includes signed witness testimony that would constitute perjury if it were intentionally false - remains deeply hidden because that information hasn't been leaked/spread through the media.  We'll know in 45 minutes.

@dandogwood I SOO AGREE!!! plus DNA !!! and it just was stated that shes claims she was drugged, but the toxic reports state otherwise..she just wanted to be his girl..but..he just wanted sex..period..even if he had sex with her...

@dandogwood Well while I have issues with it the biggest issue is that someone who is impared cannot give consent under the law.  The timeline will sink her in the end though.  Really?  A year?  Man they gonna dig all up in her background and its gonna sink her.

@MatthewEugeneHaag @dandogwood this case should of never takent this long. Tallahasee police really screwed teh pooch here. The cop who told this girl not to pursue it should lose his job. The only reason this went this long was because of the cops not the alleged vicitm  She did everything in her power to report quickly. The fact is she says she was raped and dna proves the guy in question was winston. She didn't want a ring or anything. If she wanted that she wouldn't of called cops an hr after assault. she would of waited a few days to see if guy called her back only an idiot thinks a girl reporting so quickly is looking for a ring.

@miket23 "The DNA match alone does not prove that Winston, a leading Heisman Trophy candidate, sexually assaulted the woman, as the accuser’s family claimed in a statement released by a Tampa-based attorney on Wednesday. But it does indicate that Winston, who has yet to talk to Tallahassee police or the state attorney investigating the case, had his DNA associated with the accuser on Dec. 7, 2012, when the accuser claimed she was sexually assaulted at an off-campus apartment."
