State attorney unlikely to decide on Jameis Winston charge before Thanksgiving

Florida State Attorney Willie Meggs said Saturday it is unlikely that a final decision will be made before Thanksgiving on whether to charge Florida State quarterback Jameis Winston in a sexual assault case, according to the Associated Press.

Meggs’ statement finishes up a week in which attorneys for the Florida State quarterback and Heisman Trophy candidate, and his accuser exchanged contrasting statements on the alleged sexual assault.

Winston’s attorney, Timothy Jansen, suggested that the player and the alleged victim may have had consensual sex.

Jansen’s comments followed the release of results from a DNA report showing Winston’s DNA was found in the underwear of the accuser. Jansen said he was “not surprised” that the DNA was found and that he “anticipated” it would be discovered.

The family of the alleged victim issued a statement disputing the sex with Winston was consensual.

“To be clear, the victim did not consent. This was a rape,” the family said in the statement, released late Friday.

Prosecutors have the DNA report and have also interviewed the victim. Meggs on Friday said that prosecutors — who have the DNA reports and have interviewed the victim — need to complete four or five elements to their investigation before coming to a decision. A day later, Meggs said that “not everything has fallen into place.”

“I very seriously doubt that we will be finished by Thanksgiving,” Meggs said. “We still haven’t gotten everything we need to get.”

Whether or not Winston is charged with a felony could — but not automatically — determine his status for the remainder of Florida State’s season. The Orlando Sentinel reported Friday that Winston may not be suspended automatically from the football team if he is charged with a felony because the FSU athletic department code of conduct includes a provision allowing for exceptions to the suspension rule.

The Seminoles’ athletic policy manual reads: “In the event the student-athlete is charged with a felony, absent extraordinary circumstances as determined by the administration, he/she will not be permitted to represent FSU Athletics in game competition until such time as the charge is resolved and all court, university and athletics department conditions for reinstatement have been met.”

The undefeated Seminoles — ranked No. 2 in the latest BCS poll — are scheduled to end their regular-season schedule next Saturday against Florida.

The alleged sexual assault was first reported to police in December. The family said earlier this week that the victim did not know the identity of her attacker until early January, when she identified him as Winston.

The personal injury lawyer / aunt could have her own motives of monetary gain.  The timing of her involvement  and constant public statements is quite curious.  All this publicity / free advertising of her name in Gator country will surely attract many additional clients to her practice.  Just adding 2 extra personal injury cases per week for one year will certainly yield many millions of dollars of extra commissions (at 40%) from all those car accident victims.  

Ambulance chasers are ambulance chasers; even if the clients they contract are truly injured.

Yes, their clients are often deserving of the settlements they get for their injuries; but finding clients is the most difficult part of their businesses.  

Her niece's circumstances are simply a means to an end, for her business interests- unlimited new clients.    

The competition for legal clients in the personal injury business is fierce; just watch cable TV for an hour and notice all those Wingle, Dingle, and Dangle lawyer ads aimed at accident victims.  A highly competitive business.

Whether charges are filed or not. Whether her niece is telling the truth or not.  Whether Winston is guilty, or found guilty or not.   This ambulance chaser sees this as a win-win situation for her.  Tons of (otherwise costly) free advertising.  Millions of extra future commissions.   This is a fantastic opportunity for her; like an ambulance as big as a Boeing 767 full of potential clients.  What else should we expect from a personal injury lawyer?  Run Patricia run.  Opportunity only knocks once.

The reason Winston's attorney produced 2 affidavits in support of his client, was because he knew the scope of the problem initially and wanted to quash the case, before it got out of hand.  It looks like the family friend, personal injury attorney Patricia Carroll, created the media event to make a case, but the facts do not fit the plan.  This is what happens when an amateur attorney is allowed to work a case in the media.  The State will make a decision at some point.  The next step for the family will be to call in Gloria Allred, who has a talent for getting something out of nothing.

@dandogwood Could it be that NO charges have been filed because there is NO evidence of rape? Could it be that the reports that she allowed pictures to be taken of her having sex with Winston are true and thus proof no rape occured? Two weeks ago the victim praised Winston on Twitter as the best QB in the country, does that sound like a rape victim?

A report released Friday said that a person within the state's attorney office has stated there will be NO charges against Winston and they are giving the accuser time to recant before they charge her with filing a false police report. Word is pictures from that night have surfaced, one of the pictures shows her having sex with Winston, with her on top! That is NOT rape

Do a bing search on Willie Meggs.. interesting how he was born and raised in Tallahassee, went to law school at FSU and is now in charge of deciding when and if an FSU star player might face felony charges.  I am going to go out on a limb here and say he is also an FSU contributor...     So now what do you think the chances of charges being filed are?

Hey COOL how many times have you heard of a women being raped that was aware of what was going on and no weapon involved that didn't try to scrape the rapist if not being forced down. Or if being forced down not having bruising on her wrist or throat? The only DNA was in her panties proving consensual sex. He can't help she performed in front of a crowd. Or decided it was a bad idea afterwards to do so. Her police report even says no forced damage was commited and the motive was sexual gradification. Look it up!!!

The key thing in this case is there were witnesses that say it was consensual and she kept quiet and went on about her life, which is documented, and waited 11 months to come forward after Jameis becomes a star!! If I had a daughter and said she was raped, I would move mountains to get justice immediately!! I would NOT wait 11 months.

Nov 22 - Carroll also criticized those who pointed to a police report in which the accuser placed Winston’s height between 5’9″ – 5’11″ saying “DNA is not 5’9″ to 5’11″ DNA is Jameis Winston.” She also mentioned that Winston’s lawyer only attempted a consensual defense after it was revealed that crime scene DNA matched his clients.

So it seems that the accusers attorney either wants to keep the headlines very negative, or like you, has not read any of the case material. Because his defense has always been consensual, from January 2013, signed affidavits are hard to change, it is just too bad that Jansen has been a good attorney and kept his defense out of the paper. It does also seem a bit coincidental that she lives in Tampa and the Tampa paper broke the story (watch the Tim Jansen interview on wctv.tv to hear him say that the Tampa Times inquiry into the case actually had the case number, that is something that only the victim, accused and TPD would have known since this case falls under the rape shield law).

So since I don't know what happened, I am not just going to assume.

One side says sexual assault the other says consensual sex.  The two were dating, while attending classes on campus.  Yes, living off campus, she called in a report to the campus police, who referred the case to the local police dept.  For whatever reason, she gave the wrong physical description & did not identify Winston right away, naming him later.  Now that Winston has become a big deal, the case was broadcast thru the media by the family attorney.  The state will make a determination, based on merit, but low common denominator---it's all about the money.  That's what my brain tells me.

@SuzanneinPanamaCity @WHO*IS*ESPN Many rape victims do NOT press charges, thru fear of harassment and threats by the rapist and his friends and family.  Many women also don't press charges due to the extreme psychological damage that rape does and the inability to process the idea of facing the rapist again in order to convict him.

I hope your daughters learn that lesson soon..

@Gilby Thanks for posting something that has nothing... let me repeat... nothing to do with this case.  What in the heck are you on?   Hey, I even know that Meggs supposedly is tough on players.. but amazingly has a really poor record when it comes to prosecuting them... On the outside he looks tough on players, but he is winking and nodding at them on the side.. it is all political.    As for the accusers attorney... well, she is representing a client who had semen in her panties, that belonged to the accused... do you think her UF graduate lawyer planted his semen there?

@jsk @Water-Faery @Gilby I came up last December!!  The police harrassed the woman, and then stopped investigating, hoping it would go away!  The fact that they refused to finish investigating is the ONLY reason it came up now and she and her family released a statement saying they did not know anyone else knew of the allegations!

@Water-Faery @Gilby Not much incentive?  Ever hear of a civil lawsuit that gets settled?  Usually happens after a failed criminal case.  You think it's coincidental that it comes up now that he's a surefire millionaire?  And I'm an Ohio State fan, so if anything, my team would be better off if Winston is suspended.  That's how ridiculous I think this case is.

@Gilby Love how it is the accusers attorney who is being blamed for fanning the flames, when all along it has been Winston's attorney out front and center.. first suggesting there was no sexual contact.. then once the semen and DNA were revealed, he kind of changed the story to.. well it was consensual.   Hey, I believed him at first, but now with the evidence and the change of tone on his attorneys part.. I think they are hiding something, and tried to discredit the accuser in public.

I think the fact that they got a semen sample at the time, and DNA proves it was his.. somehow makes the fact that she got his description wrong... irrelevant.  She apparently said no... even if they were bf/gf  and he didn't listen... this still constitutes a rape.  I don't recall hearing about the accuser asking for money.. I don't even recall the family being the one pushing this case into the spotlight.. I believe it was some reporters who broke the case... the family has said they didn't want to have it made public, and were just now being forced to talk because of the smear campaign Winston's attorney his doing on their daughter..
