Jameis Winston accuser’s attorney: ‘This was a rape’

The attorney for the alleged victim in the Jameis Winston case released a statement Friday night refuting claims that her client had consensual sex with Winston.

After the Florida State QB’s attorney issued a statement on Thursday claiming that his client and the accuser had consensual sex, the alleged victim’s lawyer, Patricia Carroll, released a statement saying, “To be clear, the victim did not consent. This was a rape.”

Carroll  criticized those who pointed to a police report in which the accuser placed Winston’s height between 5-foot-9 and 5-11, saying “DNA is not 5-9 to 5-11. DNA is Jameis Winston.”

She also mentioned that Winston’s lawyer only attempted a consensual defense after it was revealed that crime scene DNA matched his clients.

Winston has not been charged with a crime. Through his attorney, Winston has denied the charges since they emerged publicly last week.

I do think it strange that this is just coming out now when the actual event allegedly happened about 10 months ago.

Looks suspect.

Think about it people. If Jameis Winston was not an athlete, and just a kid from the streets, nobody would be defending him. We know nothing about Jameis Winston. So what makes him different than any other rapist? The only reason people are defending him is because he is a high profile athlete? That's it? So because he plays football, there is no way he is guilty? OJ was a pretty fair football player. So was Rae Carruth. So was Ray Lewis.

FSU has to suspend Winston to maintain the integrity of their school and Football program. Rape charges are sick and sad. Set the kid till this is solved and settled.. Think of the poor raped girl?

For the record, "No" means "no."If you force sex on someone that says "no", it is rape. If a women (or a man for that matter) is incapable of saying 'yes', even if she is drunk, and sex is consummated, it is rape. All you he-men who think a passed out woman is fair game, are seriously mistaken.

I am in no way commenting on this particular case because I only know what I've seen on the internet, and that is very rarely reliable. But it's good to remember the above for future reference. By the way, just as an aside, when you boys get drunk, and if some other guy has sex with you when you're passed out, would you think you had asked for it? Just asking.

Just another college athlete who thinks their glorified status (sic) allows them to violate the opposite sex with impunity. I'm sure there are many of you out there that scoff at the allegations that in all likelihood are true, however, time and time again these athletes are accused of moral atrocities that we should never, as a society, let go unpunished. Throw these sexual predators out of school and in jail. Unless harsh penalties are met out, these ignorant athletes with no morale compass will continue to prey upon the innocent.

Some gossip sports sites are reporting there are pictures of the two of them together before her fb/twitter/instagram accounts were suspended.

What's  Winston's past behavior? I remember reading how O.J. had a history of  abusive behavior at USC and because he was a big football hero,he was untouchable. Does Winston have a history? Or is he squeaky clean?

No woman deserves to be sexually assaulted, but where is the proof in this case? There should be a cardinal rule -- if it's a case of he said/she said, and there was no rape kit performed or anything like that, case closed. He should have been charged immediately when it came out a year ago, so I think this case has no merit. I think this will only cost him the Heisman, because some voters will pre-judge him before hearing all the facts. It's a shame, because he's a great player. He should just focus on trying to win a national title, and maybe he can be the Heisman front-runner next year once all this blows over.

@Blake12 I hope you don't really believe that.  Studies have shown sexual assaults to be among the most underreported crimes.  Victims are often stigmatized, etc.  Don't be part of the problem.

@dandogwood I'm just wondering why any man would have to force sex on an unwilling woman when his girlfriend was flying in either that night or the next night?  Pretty sure he would be getting all he wants while she is there.

@TheVon Sports site are NOT the ones to be necessarily reporting the whole truth!  There have been some videos and pics that people CLAIM are the girl that was raped, but those have all been debunked as not being the same girl.

@HarshRealities the alleged victim in the duke case was a poor black girl, and the accused were rich white boys.  i don't remember particular statements from either of the parties, per se, but i do remember the tone and framing of the news stories surrounding the case.  the coverage of this winston case is very different.  the media and police have been much more standoffish and unwilling to really sling mud either way.

@thebigdawg3 I highly doubt he has no problems, this is a huge one (QB in Tallahassee at FSU or not). Do you understand what's happening here? "Famous" is taking on a whole new meaning with, or without, criminal charges. He will not represent FSU in a Nat'l Championship Game - even if the DA does not press charges.

@doublejtrain68 That is a ridiculous statement!!  Most rape victims don't have the mental presence of mind to go GET a rape kit!  Many rape victims have no ability to get a rape kit before the time by which the evidence would be spoiled, as they have been drugged or knocked out before, during or after the rape.  Your suggestion is totally reprehensible to rape survivors, men and women alike.  The percentage of false rape accusations is FAR smaller than the percentage of REAL rape accusations . . .so what you want to do basically allows rape to become more prevelant a crime than it already is.  One in three women worldwide are raped.  Will you be happier with one in 2?  Every other woman you see will have been raped as opposed to one in every 3-4 women around you have been raped?!

@doublejtrain68 Except that there was a rape kit done, which is how they got a DNA match, almost immediately after the incident, and a police report filed.

@j7apple @TheVon The whole scenario started out with the victim not knowing who Jameis Winston was.  If she had pictures with him, that kind of undercuts her story.    I'm waiting to see how this whole thing plays out, but I find it interesting that this "investigation" is being played out in the media through both lawyers, which I find distasteful.

@historiskull While the smart thing for FSU would be to hold Winston out of an easy win vs Idaho, they would need him for the Florida game. It's not likely that this case will be resolved by then. Right now, the NCAA is probably pulling for any FSU opponent to win and avoid the embarrassment of FSU/ Winston in the NCG.

@Water-Faery @TheVon @j7apple And why couldn't this so called threat that you speak of  have been just a warning of what she would be facing?  We all know how football towns are so maybe they were just letting her know what she would be going through.  This alleged sexual assault happened before he was even chosen as starting QB so why wait till now to proceed with accusations?  And what about the witnesses?  Even if they were not in the same room at the time, surely they would have heard it so why didn't they stop it and why aren't they being charged with accessory to the fact?  Too many questions unanswered so until it is actually proven...what happened to the American way..."INNOCENT TILL PROVEN GUILTY" not guilty till proven innocent.

@TheVon @j7apple Perhaps if the police had finished investigating instead of hoping it would go away with their threat to the victim, it would have been finished last year when she was raped.  Its not the defence's fault that the police did not do a good job here.

@Water-Faery Because, I'm afraid, the 'rape culture' is so entrenched that men can't imagine being held responsible for their actions. If a woman has flirted with them they think they have a right to sex with her, even (or perhaps especially) if she is passed out. They tell themselves 'no' means 'yes'. It is contemptible. But you know that better than most. So sorry for, to me, an unimaginable experience.

@blee_ You don't know that to be true. You are only hearing that from a defensive TPD spokesperson. It is interesting that the former commissioner at the time has retired and no one is asking him why this case was mishandled by him.

@blee_ If you take a look at all the reports that's been out, you'd see that the police/city officials had been lying to cover their asses regarding their case.

We had people from the city and the police saying that the girl was drunk, when the tox report said she's clean.

We had people from the police saying that the case was referred to the DA/SA before the case file request was made from TMZ and TampaBay Time, when it turns out to be false.

We have the girl's lawyer stating on the record about her interaction with the police, with the police department not being able to directly refute what's being stated.  (Just so you know, a lawyer might be able to get away with lying about their client, but they can't get away with lying about their own experience, especially interaction with law enforcement officials.  It's something they'd lose their license over.)

I absolutely agree with you, especially given the fact the girl wanted the case dropped and cut off contact with law enforcement.
