Tom Brady, Gisele Bundchen bodyguards sentenced to 5 years after shooting

Miguel Solis and Alexander Rivas, former bodyguards of Tom Brady and Gisele Bundchen, were found guilty of attempted murder and sentenced to five years in prison on Friday after an April 2009 shooting in which the men opened fire on photographers during the Brady-Bundchen wedding in Costa Rica.

The three judges in the court in the resort town of Puntarenas voted unanimously on the case. Another bodyguard, Manuel Valverde, was acquitted.

The defendants, who refused to testify, were ordered to pay five million colones (about $10,000) in damages to the two photographers — Yuri Cortez of the Agence France-Presse (AFP) and his Costa Rican colleague, Carlos Aviles.

The bodyguards confronted the photographers and demanded they hand over the memory cards in their cameras. They refused, and as they drove away, at least one of the bodyguards opened fire, according to the complaint against them.

Neither photographer was harmed.

Opening  fire wasn't wise, but these gate crashing photographers need to be stopped. This isn't like Jackman and Hanks talking to reporters. This was a rude intrusion into a private moment. Notice the jerks little victory dance?

I find it amazing that Hugh Jackman and his wife who are much bigger celebrities in the world manage to go through each day taking their kids to school, going out to eat, shop and live in NYC WITHOUT bodyguards, and are friendly with reporters (they smile and nod to them).  He doesn't pack a gun or have bodyguards who have guns wherever he travels in the world.  He is an amazingly nice person, and very talented. (We saw his 16 week Broadway show of dancing and singing.) He isn't married to a supermodel either.  He has been married to the same woman who is 13 years older than he is and he is quite open about loving her completely.  And Christ he's WOLVERINE! 

But then actors such as Jackman and Tom Hanks are actually intelligent people who don't make a damned spectacle of themselves.  These sports celebs, rap artists with posses and armed bodyguards are just pathetic.  Yeah that's YOU Tom Brady/Bundchen.  Get OVER yourselves!

Armed Guards?  Ridiculous.  Have a quiet, private UNANNOUNCED wedding in an obscure place.  They bring ti on themselves then expect their "employees" (hired thugs) to harass or shoot anyone doing their job as journalists.  Grow up Brady!  He should have been sued for civil damages by the photographers.  Brady hired those small brain Neanderthals with lethal weapons.  Brady KNEW they could kill someone.  "Oh so what?"  I'm an NFL QB with a 2013 rating of 56.7.  My life is more important than any common human being there!"  Oh yes this is the same wonderful man who was dating Bundchen while his ex-wife was pregnant with his baby...Then he brings that baby to the wedding?

Brady has ABSOLUTELY NO CLASS!

I guess Tom and Giselle are happy it happen in Costa Rica,since in U S they would've been charged too. What this article didn't mention was they said they didn't know the bodyguards,even though they went where ever they went for 5 yrs. Some boss/role model they are.

@Nuschler Brady & Bunchen hired local security guards for their private wedding in Costa Rica.  Neither had anything to do with the shooting and were dismissed from the lawsuit.  Normally security guards are hired, under contract, with or without arms.  Brady told Peter King he heard no shots.  Maybe security guards do things a little differently down there in Costa Rica, but most of the comments against Brady-Bunchen are based on guess work.

You know whats funny, if it were say, Cam Newton, the same people bashing you would be saying HE should be charged and they know it. Interesting way this story has been "covered" since it occurred. I'd say the vast majority of players in the league would not get this kind of coverage and nonplussed reaction if their names were attached.

I assume his point -- and it's a correct one -- is that if it happened in the US, Brady and his wife would have been liable.  And they would have been.

@leehwgoc @SpartanTarget @eddie767 - It appears that the Costa Rica case was a civil case, not a criminal case. So they (meaning B & B) were not "charged," they were named as "defendants" (respondents) by the plaintiffs. The judge let them off the hook. The same could happen here.

Would B & B have been "charged" criminally in the US? I don't think so. If the contractor is not operating under the direct supervision or instructions of a principle, the principle is not responsible for criminal acts of the contractor. This won't necessarily prevent an over-zealous DA from charging the principle, but, lacking evidence of direct instructions or supervision, a judge is likely to dismiss the charges..

@leehwgoc @SpartanTarget @eddie767 Hold on there leehwgoc...firing a gun at someone is pretty clearly an intentional tort, and employers normally ARE NOT held liable for intentional torts committed by their employees.

I think the distinction would be whether firing a gun at someone would be considered within the course and scope of their employment. It's possible it was, since they are bodyguards who apparently were authorized to carry firearms, but either way that's a fact issue, so you can't summarily say that Tom and Giselle would have been liable.
