An attorney for Florida State quarterback Jameis Winston denied year-old sexual battery allegations against his client that were reported Wednesday by TMZ.

No charges have been filed against Winston. The investigation remains active.

“This case has been going on for over a year. The case was basically closed and we’re not sure why it’s opened up,” Winston’s attorney Tim Jansen said. “We’ve been cooperating with the law enforcement agencies and we’re hoping to get a quick resolution in favor of Mr. Winston.”

The police report for the complaint, which was filed on Dec. 7, 2012, listed the alleged perpetrator as between 5-foot-9 and 5-11. Winston is listed at 6-4.

Florida State declined to comment on the report.

“We are aware of a matter that was investigated by the Tallahassee Police Department almost a year ago. Because the investigation has not been closed by TPD, we cannot comment further at this time. We look forward to a speedy resolution of the issue. There is no change in Jameis Winston’s status Coach Jimbo Fisher and Jameis will be answering questions about football only until there is a resolution,” Florida State said in a statement.

More from the Tallahassee Democrat:

The report, which was heavily redacted, does not mention Winston by name. It says the complaint was received at 4:10 a.m. and that the sexual battery occurred earlier in the morning of Dec. 7, 2012, between 1:30 a.m. and 2 a.m. The exact location was not listed, though the report says it happened at an apartment.

The incident report says the suspect is unknown. The narrative description from the investigating officer is redacted. The incident report describes the suspect as between 5 foot 9 and 5 foot 11 tall and 240 pounds. FSU athletics media guide lists Winston as 6 foot 4 and 218 pounds.

If there wasn't anything to charge 11 months ago I doubt anything new has been discovered. This sounds like the TPD and SAO are doing their job so that no one can accuse them of not doing it later.

This has the Red Elephant Club all over it. Just like they did to Cam and Johnny Football.

What do Winston, Cam Newton, and Johny Football have in common? They were all targets/victims of legal shenanigans...all initiated by the same person....who happens to be a Alabama Alumni, close friend of Nick Saban's, and a member of the infamous Red Elephant Club.

Coincidence?

Hope this is a learning lesson for him, you come in as a 2 sport star with all the oppurtunity in the world, you have to realise who's your freinds and who's not, what type of situations to be in and what one's you need to avoid, to much talent and oppurtunity to be wasted because you don't understand your surrounding's, regardless if he did it or not you just have to be smarter than that.

There is one hill of a difference between someone who is 5'11 and 240 lbs (medium height but obese) and 6'4 and 220 lbs (tall and lean).

The police find no reason to charge.  Then, months later, it's leaked to TMZ and resurfaces.  What happened?  The aunt of the "victim" is an attorney, and smells money.  Lawyers are the lowest form of life in America.

Find out who publicized this against Winston? Had to be the other Heisman front runners.  This smells of Manziel and his sliimy parents. Low class all the way. But if Winston did do the sex assault dump him him immediately and throw him in jail.

Let's see. The alleged perp was five inches shorter than Jameis. Jameis has not been questioned and according to the police is not a suspect.

So this is a story why?

you know why this was brought up, it's because the 4 letter needed someone else to drag through the mud.  i mean again who drove the manziel story, the 4 letter, even after it was found out there was no there there, now we have the 4 letter doing this.  The 4 letter is desperate and it's garbage like this why people view the 4 letter as pardon the pun "A mickey mouse" outfit

Sure seems like someone is trying to ambush a Heisman campaign.

This is a non-story.  Athletes are investigated literally every day.

If the kid is guilty fry his butt and put him in jail.  If Winston ain't guilty then move on.  Not really great publicity for a heisman candidate so close to the voting?  Something smells?

Didn't his parents know there's no I in James?

I hope people don't rush to judgement here.  He has so much going for him, I hope it's nothing.  I'm an OSU fan and could benefit from something happening, but still hope it's nothing and goes away quickly.  Not sure why it's even being reported.  Agree with BrettRoar, if he was in the SEC, probably wouldn't have surfaced.

A non-SEC kid... The NCAA will destroy him in quick order.

With 3 losses manziel shouldn't even be in heisman consideration.

Sounds like the last time black kid was involved in a crime....but got blown away. FAIR trial and then they got p.o.'d at the result which didn't go their way.

Winston says, "If I ever get Manziel disease, I want all of you to smack me in the head with your microphones."

No way to know if this has any merit or not. Only time will tell. However, from the "Scam" Newton precedent, I think it's safe to say that if there is any future sanction against Winston, it won't happen during this season or this season's bowl game.

Hey Shaniqua! He hasn't actually signed with an NFL team yet!

Perhaps SI should look into whether the author of this piece really needs to be employed. While there certainly could be more facts as yet unknown, based on the information presented in the piece itself, the article is dangerously close to libel.

@steve4nj  I watched this happen repeatedly to Johnny Manziel without a shred of truth to any of it - yet people continue to believe he is a trouble making rich kid because they think the people at ESPN etal would never report things that aren't true.  Nothing could be further from the truth - and, nothing has ever been proven that Johnny is anything but a great QB.  I hope Winston's attorneys nip it in the bud fast.

@Steve22 "if he was in the SEC, probably wouldn't have surfaced"

What size tin foil hat do you wear?  The SEC has it's fair share of arrests.. more than their fair share on the big name teams.  Now you are saying that there is a myriad of other crimes that don't go reported?  I'm sure you have something to back that up because we all know people don't make stuff up on the internet just to get a dig in at someone else.

@WHO*IS*ESPN I think every lawyer in every case from the beginning of lawyers has said "We're hoping to get a quick resolution in favor of (our client)"... I'm not sure why you chose this cliche quote used by almost every lawyer to apply to a specific crime just because it involved a black kid.  Lawyers have said the exact same thing about white, Asian, Hispanic clients of all ages.

JeremyJohnson

@WHO*IS*ESPN What exactly are you saying?  Nothing in this report leads a reasonable person to believe Winston was involved.

zacktrobertson

@Snow_Veil It's being reported on pretty much every major network, but the real issue here is why this is just now suddenly making the internet rounds despite their being hardly any clear information connecting Winston with the incident. Seriously, a year ago? If the police were seriously considering him as a suspect we'd have learned about this a long time ago.

@JeremyJohnson Dude is a racist internet thug.  I hate people who hide behind the wall of the internet.  Well lucky for us there is a new software that tell you exactly who the person is making the comment and the address where the tweet, or fb comment comes from.   @WHO*IS*ESPN be warned. That is all.

@zacktrobertson @Snow_Veil "If the police were seriously considering him as a suspect we'd have learned about this a long time ago."

If he weren't the starting QB of the almighty, all-glorious Semenholes, he'd have been in a jail cell in January, whether he was guilty or not (and I sincerely hope he is).  You know it and I know it.
