Report: Richie Incognito expected to file grievance against Dolphins

Richie Incognito, the suspended Miami Dolphins offensive lineman who allegedly bullied teammate Jonathan Martin, is expected to soon file a grievance against the team, reports FOXSports1′s Alex Marvez.

Incognito was suspended indefinitely by the team and stands to lose his weekly salary of $235,294.12.

Incognito and some of his teammates have denied that he bullied Martin, a second-year offensive lineman who left the team in late October.

On Tuesday, in Incognito’s most recent comments about the scandal, he said, “I’m just trying to weather the storm right now. This will pass.”

Martin has yet to speak about the allegations, but a voicemail that Incognito allegedly left for the former Stanford player included a racial slur, expletives and threats against Martin and his family.

As much as I hate them, I have to say this whole thing would never happen to the patriots, or 90% of the other nfl teams. Why? Because the Dolphins will go with players like incognito because of what the franchise is, sadly. Does bullying/hazing occur elsewhere in the NFL? I would imagine.  But having Incognito as a leader on the team only spells trouble and dysfunction. Which fits right in with the dolphins.

Sports Law talk is remarkably silent on this case, presumably because it is very complex and uncertain, despite a lot of known factual information.  The NFL recently hired an outside attorney to investigate.

Kick him out of the league. He has been sued by woman for assault, and now this? It isn't like he is going to be able to go to another team. How many guys are going to welcome a drunken baffoon who calls his TEAMMATES Nigggger? Try that on the Raiders and this guy would be dead by morning..

The reality is that these things were most likely said in a joking or mildly serious way by Incognito.  Incognito's problem, however, is not what he said by the medium in which he did it.  This is a 24/7 news cycle-everything-you-say-and-do-is-obsessed-over society.  Richie might not have been seriously threatening the guy, but it doesn't matter.  He left a voice mail and other evidence behind, evidence that must let itself speak with no interpretation.  He was foolish enough to do that in this day and age, and now he'll pay the price for his lack of foresight.

  Thats all this story is - a less than all-there football player making a series of (probably) harmless jokes, but taking them too far in a twitter/blog/facebook world.  He should have known better - and now he'll find out that it will cost him - weather you agree with it or not.

I think Incognito is a POS.... That said, I hope he wins his grievance against the team.  The people that should be punished start at the top with Jeff Ireland (worst GM in the NFL) and Joe Philbin.  Philbin seems like a decent guy but if he was aware of the situation and still let it go on then he needs to be punished before Incognito is.  

As for Martin.... Good luck in your next career!  He'll never play in the NFL again...

Martin really was an outsider in that locker room.  He was intelligent and didn't want to waste his money on stupid things.  He had nothing in common with the people in the Dolphin locker room.  Morelikely, he could have fit in the New England Patroits...SF 49ers, Seattle Seahawks, and a number of other locker rooms. The Miami Dolphins have no leadership.  Martin would fit better in a veteran locker room.  I going to be money on the Dolphins opponent this weekend.  With the offensive line missing to starters, the QB will be eaten alive.

Let's see:  You racially abuse a teammate, with the most vile threats possible.  You get found out about, and then have the cojones to sue the employer?  I would love to hear Stephen Ross' comments about this racist pig.


There is NEVER a reason to use such vile language or threats, and what else is Martin to think?  Martin could have sunk to his level and fought him, thus risking his health and standing, or just leave it alone.  I hope Martin overcomes this and moves on.  Incognito will always be a racist pig.

We have no knowledge of hazing in our organization, that is why we suspended Incognito indefinitely.

As a retired businessman I've had direct experience with the legal exposure a business has when there is a "hostile work environment" which is determined by whether the EMPLOYEE (in this case, Martin) fells that the work environment is hostile.  Clearly Martin does believe the work environment is hostile because he walked out and sought medical treatment; and every time one of his teammates says something to back Incognito, the environment becomes more hostile.

I'm not making this up, it's the way the law is.  The Miami Dolphins have a significant exposure to a harrasment lawsuit by Martin and with the texts and voicemails by Incognito, the lawsuit would be a virtual slam dunk.

At first I thought he was a real jag-off because of the "bullying" and his past nonsense. But now everyone is piling on and I don't think he should lose his job over it. Yeah Martin is a big dude but obviously he has some issues and he's not a fighter. He should not have to lose his salary for the rest of the season. But I am sure some team will pick him up next season. Big huge offensive linemen with his experience and no injuries are hard to come by.

It was NOT a legitimate threat to kill anyone. The kind of language he used is the kind of language many people use in private, among people they know. What next, shock that sailors swear?

I started out firmly in Martin's corner, but now realize this is nothing more than another example of the feminization of society.

This was not real racial harassment, this was not a real death threat, and I am sick to death of all the double standards. Blacks can call blacks "the N word" (and it is moronic that you have to say 'the N word" so people don't pass out due to getting the vapors), they can call women "ho's", other ethnic groups can even call black people N's, but let a WHITE man do it, even among a group of people where it was thrown around constantly and with approval even, and then the press finds out about - why that man must now be branded with a Scarlet N, and shunned forevermore.

@AaronDunckel I somewhat agree. Is there audio of the voice mail? I think context would play a lot in figuring out if he was threatening or just joking around.

@Hola Taking a shot at the Dolphins locker room?  Please.  Using the Seahawks as an example of what you think is a locker room filled with intelligent players is ... laughable.  Pete Carroll ran a dirty program in college, and left his school in the lurch by getting out just before sanctions came down.  And yeah, Pete knew about all the money that Reggie and company were getting.  Now Pete runs one of the dirtiest programs in the NFL, with over half a dozen players having been suspended in the last 12 months, and while they all say they are on Adderall - and the NFL can't release confidential medical info, I would bet my bottom dollar that most the Seahawks are doing steroids.  Cheater in college, cheater in the pros.

You're an idiot. He was laughing about the voicemail when he got it in April according to Brian Hartline. Sounds like he was scared for his life. I'm not saying the racial remarks are cool or anything but I've said stuff to my buddies about slapping their mother too. It's cause I'm playing around with them. My friends didnt take my words to the cops and cry about being bullied(6 months after the fact) they laughed cause they knew I was joking with them.

@OnePass They suspended him after all the evidence was seen. Even though they should not have. J. Martin is a quitter who used his buddy as a scapegoat. This is the same as if he had quit right in the middle of a game he was starting in. He will never be wanted in any NFL locker room again. Incog's will be wanted, his mate's on Dolphins wish he was still there right now.

@AustinRoth It doesn't matter if the threat was real or not, which, by the way you have really no idea, so you are just talking out of your butt.  All that matters is if Martin THOUGHT it was real.  That's it.  You're just not allowed to threaten to kill people in America if you're angry.  Sure, lots of people DO it, but that doesn't mean you can just say "I was kidding" when they get scared.  And if you are going to make death threats, try not to do it on a recording.

@MichaelSullivan2 @OnePass The Dolphins locker room was devolve of any leadership.  Incognito may or may not be a racist.  There are a number of players that think he is a racist, other than those on the Dolphin team.  Martin should have done an Aaron Hernandez on his azz.  The bullying would have stopped immediately.

@AustinRoth @Mr. J Unfortunately the NFL is NOT exempt from Workplace laws. It will be very hard to prove the Mr Incognito was Just Joking from text messages and voice mails taken out of context. I know of people getting walked out of the office because someone just overheard them "joking with a fellow employee" and ran to management. Its time for the NFL locker room grow up!
