Niners’ Aldon Smith faces felony weapons charges

San Francisco 49ers linebacker Aldon Smith faces three felony charges for possession of assault weapons, according to the NBC Bay Area Investigative Unit. The charges were filed on Wednesday by the Santa Clara County District Attorney’s office and stem from a 2012 incident at a house party hosted by Smith that resulted in him being stabbed and two others shot.

The charges come less than a month after the 24-year-old was arrested on suspicion of driving under the influence and for possession of marijuana, an incident that led the Niners to place the 2012 Pro Bowler on an “indefinite leave.”

Smith is not charged as being the shooter in the 2012 incident; rather, prosecutors are looking to hold him responsible for hosting the party at his house just outside San Jose. The charges do, however, indicate that Smith fired his guns during the incident and accuse him of owning illegal firearms.

Smith played in the Sept. 22 loss to the Indianapolis Colts, two days after his DUI arrest, and responded to that charge after the game, saying, “I will do everything in my power to make sure this never happens again…I also want to let everyone know that I’m sorry.”

You would think that a person would be more careful about being in possession of any type of assault weapons when they have already had earlier charges levied against them. He has already been charged for possession of marijuana and driving under the influence – both of which are rather serious charges. Why would he add to it by being in possession of illegal firearms?
