NBA Hall of Famer Scottie Pippen won’t face assault charges for allegedly pushing and spitting on a man at a Malibu, Calif. restaurant in an altercation that left the other man unconscious, reports the Chicago Tribune.

The L.A. County district attorney’s office said that there was not enough evidence to prove beyond a reasonable doubt that Pippen was guilty of committing a crime.

Pippen was dining with his wife, his children, two brothers and his mother-in-law when a man, Camran Shafighi, asked for a photo with Pippen.

When Pippen left, the man again tried to ask for his photo. At that point, Pippen allegedly punched him in the mouth and spat in his face before kicking him several times.

The last thing the man remembers before awakening in the hospital, he told police, was Pippen’s foot in his face.

Pippen told sheriff’s investigators that the man followed him to the valet stand, spitting and cursing at him. Pippen then spat back and and pushed the man away with a horizontal arm movement, according to a declaration by prosecutors.

Shafighi is suing Pippen for $4 million, claiming he suffered a “brutal and unjustified physical attack” trying to get a photo for his 12-year-old son.

So a 6'7" man with an entourage, at a probably busy restaurant gets into a physical altercation at the valet stand and there's not enough witnesses for the police to figure out what happened?
