Former NFL wide receiver Chad Johnson has been sentenced to 30 days in a Fort Lauderdale jail for violating his probation in a domestic abuse case against his ex-wife and reality TV personality Evelyn Lozada. A plea deal had been reached on Monday but fell apart after Johnson playfully slapped his attorney on the behind.

Broward Judge Kathleen McHugh said Johnson wasn’t taking the case seriously enough even after Johnson apologized for the playful slap on his attorney. Judge McHugh also extended Johnson’s probation by three months.

The 35-year-old Johnson, formerly known as Chad Ochocinco, pleaded no-contest to allegedly head-butting Lozada during an argument in August. Lozada, who appears on the reality TV show Basketball Wives, filed for divorce just a month after marriage. Johnson was then released by the Miami Dolphins following his arrest.

The 11-year NFL veteran last played with the New England Patriots in 2011 where he caught 15 balls for 276 yards and one touchdown. Johnson spent 10 seasons with the Cincinnati Bengals.

I don't understand. If she rejected the plea agreement, doesn't that mean she sets a trial date? She skips straight to sentencing?

Over reacting Judge, who had an attitude from the start.

The judge did overreact.  CJ maybe an idiot in life but she turned out to be an idiot of the court room.  Things like that make the whole legal system look terrible.  And she expects to be addressed 'Your Honor'?  I don't think she deserved it.

Chad Johnson got hosed, by a judge that is not fit to sit on the bench. She was overmatched and incompetent. I am in court every day, and believe me that was nothing. What a joke, what a joke of a judge. There was absolutely nothing wrong with what he did. It was neither disrespectful or inappropriate.  That exact behavior is being done thousands of times today, tomorrow and every day courts are open, without any competent judge even giving it notice. I am not saying Chad Johnson is the greatest person in the world, but any one who says that was just or right, has drank the Cool-Ade

1) Chad Johnson headbutted his wife then violated his probation. He deserves jail time.

2) Never make a mockery of a courtroom. You're in court for a reason. It's serious business.

The judge should have thrown him in jail to start with... maybe if everyone who violated their probation was put in jail instead of given a slap on the wrist, more people would honor the terms of their probation.

I think it was year two of law school when we learned that a butt pat after a plea bargain has been reached would result in a 30 day sentence. Seriously, has this judge already announced her run for office or is that to come later?

Thanks to all you legal experts throwing a fit on an internet comments page, the US legal system is now being overhauled. Good job to all of you.

Before I saw the video, I thought he was an idiot and probably deserved it.  After seeing the video, I think it's an absolute travesty and utter bullshite.  He pleads no contest and avoids jail time and she compliments the attorney and he CLEARLY gives a congratulatory acknowledgement of the attorney's good work AFTER she makes the compliment and she gives him jail time.  So I imagine if he shook his attorney's hands then it would have been okay, however because she has ZERO understanding of context, she gets pissed.

I'm no fan of CJ and have always thought he was starving for attention, but her reaction was over the top and I'm not sure how anyone can argue that it wasn't or that what he did was a sign of disrespect REGARDLESS of the reaction in the courtroom.

Judge sounds like a biyatch to me.  Typical chick with power.

She should have thrown him in jail as soon as he walked into court wearing earrings. FOOL!!!

That's institutional racism in America. The US criminal justice system is so focused on locking up African Americans that is turns a blind eye on people like Phillip Garrido and we saw what happened there.

This is such BS.  Any Judge should be intelligent enough to realize that a pat on the butt is a sign for good job in football.  Chad Johnson has spent over 20 years playing football and disregarding his plea deal over it is beyond ridiculous.  If you watch the video, she didn't even realize what had happened.  She was continuing on.  She's off camera and there is actually a break in the video where I bet she asks why people were laughing.  They laughed while she was on tv and he paid for it.

There ARE times to 'play the game', and one of them is when you are in court. Put on a jacket and tie and keep your hands to yourself. Although, Chad, there may be some more butt patting going on over the next 30 days.

I thought the Judge must be running for office. What is ridiculous is she accepts the plea for spousal abuse in which he avoids jail time. However, a pat on the butt gets him 30 days? Great priorities, your honor!

Chad Johnson = Idiot

This is the type judge who will give a light sentence to a white collar criminal, who rips off senior citizens retirement funds, and give a slap on the wrist to chronic repeat celebrity offenders the likes of Lindsey Lohan. But for the Chad Johnson "types", her idea of justice obviously is administered with a double standard.

This Judge should be fined and reprimanded for abuse of power on the bench.

@Brandon Coomer Everyone who violates their probation is thrown in jail... everyone but celebs and pro athletes.  Having said that however, Chad got 30 days for butt slapping HIS OWN ATTORNEY.  If he's attorney had no problem with it, neither should she.  She could have admonished him on that, but 30 days? She's def got her 15 minutes of fame.

6marK6

@Brandon Coomer But that is the point! She allowed the spousal abuse, was giving him a suspended sentence. It was the butt pat that angered her. She is full of it.

@TimGreenThumbAbbott    ... I agree - judge went over the top ...But CJ is old enough now he should grow up ...Too many times he acts like a 14 yo spoiled brat ...He's so immature it makes me sick ..Is the light bulb ever going to turn on in his head ...

@ChuckSmithYou don't treat a courtroom like a football field.  Real life isn't football.  If Chad Johnson had learned that before, maybe he wouldn't have been in the courtroom to start with.

@284518 Do you have any evidence about "this type of judge" or are you just voicing an opinion?

An opinion which is probably wrong?

John4

@GlennPalmer Actually, Wow.  That's straight up stupidity by the defendant.  Wear a suit.  Act like you care, and be respectful.  At least try to appear remorseful.

@Mark St. cyr @MattParker God has given me the intelligence to earn a master's degree and has blessed me with over $1 million in assets, so you are right. I am intelligent and I have a God given sense of right and wrong. I know wrong when I see it and  Judge Kathleen McHugh was wrong.

DougBeers

@John4 @GlennPalmer BS!  wearing a suit makes you less guilty?  This is why our system is flawed.  I wondered about this incident, until I saw it for myself.  That judge is not only out of line, she's a disgrace to the robe and to the system altogether.  Johnson was being respectful.  He was showing remorse and genuine concern.  He needs a suit?  That's incredibly stupid and the butt slap was not disrespectful to anyone except in her own mind.

John4

@DougBeers Doug - note that a plea agreement seemed to include 25 hours of community service.  Then the judge got angry and dismissed the plea agreement.  Then she stated that Chad Johnson had violated the terms of his probation.  (If I heard the recording correctly).  Then she sentenced Johnson to the 30 days.  Now, how many days (of that 30) that Johnson will spend in jail?  5?  10?  Less than 20?  The judge can be a hardass all she wants, but clearly Johnson will be out of jail very quickly.  What do you think?

John4
John4

@DougBeers Doug - I respect your opinion.  You could be right about many of the things you state.  Consider this:  There is a time and place for everything.  The judge  obviously did not think the courtroom was the place for Johnson's behavior.  Football fields mandate a football uniform.  It is customary and a very good idea to wear a suit when appearing in court as a defendant.  Just my opinion.  Peace.
